TEDxWarsaw 2021: Polarization - Event Policy

  1. GENERAL TERMS AND CONDITIONS
    1. These Terms and Conditions define the conditions of conduct and participation in the "TEDx Warsaw 2021" artistic event (hereinafter referred to as "Policy").
    2. The Organizer of the artistic event entitled "TEDx Warsaw 2021: Polarization!" (hereinafter referred to as the "Event") is Marek Zawada, who runs the business activity under the name "Smartest Heads Marek Zawada" with its registered office in Warsaw (00-815) at ul. Sienna 86/126, entered into the Central Registration and Information on Business Activity, holding NIP 5213105984 and REGON 147109817 (hereinafter referred to as the "Organiser").
    3. The Event will feature original speeches by speakers - prepared especially for the Event - in accordance with the Event programme posted on https://tedxwarsaw.org. There will also be artistic performances during the Event in accordance with the information posted on https://tedxwarsaw.org.
  2. DATE AND PLACE
    1. The Event will be held on 10th June 2021 in Warsaw at Kinoteka at pl. Defilad 1 (Palace of Culture and Science) between 10:00 and 17:30.
    2. Due to the prevailing SARS-CoV-2 coronavirus pandemic (hereinafter the "Coronavirus"), the Organiser reserves the right to change the date and/or formula of the Event, as well as to cancel the Event, of which each Participant will be informed by e-mail or via the Organiser's fanpage available at https://facebook.com/tedxwarsaw.
  3. PARTICIPATION TERMS AND COURSE OF THE EVENT
    1. The Event is open to adult individuals who on the day of the Event:
      1. are not infected individuals or who suspect themselves to be infected with the Coronavirus,
      2. are not in quarantine related to the occurrence of infection or suspected infection with the Coronavirus,
      3. are not under epidemiological surveillance.
    2. Participation is conditioned upon:
      1. registration for the Event via https://tedxwarsaw.exposupport.pl/,
      2. payment of the fee for participation in the Event in the amount of PLN 250.00 (two hundred and fifty PLN 00/100),
      3. acceptance of this Policy,
      4. receiving a confirmation of correct registration for the Event.
    3. The Organiser may block registration and registration for the Event in the event that the Event venue is full and it is not possible to admit all participants to the Event.
    4. The Organiser reserves the right to refuse entry to the Event site to persons who show symptoms indicating a possible infection (cough, breathing difficulties, malaise, elevated temperature).
    5. The cost of the event for a participant is 250 PLN gross (two hundred and fifty PLN 0/100). The amount covers the cost of participation in the event. Payments are made through the Przelewy24 platform in accordance with the regulations of https://www.przelewy24.pl/regulamin.
  4. SECURITY AND HYGIENE
    1. The Organiser is not liable for items left, lost or stolen during the Event.
    2. Participants are required to comply with safety rules, health and safety regulations and fire safety regulations in force on the premises where the Event is organised.
    3. Participants are further required to observe all health and safety measures in force in connection with the prevailing Coronavirus pandemic. On the Event site it is obligatory to cover the mouth and nose and keep a distance of min.
    4. In the area of the Event it is obligatory to cover the mouth and nose and to keep a distance of min. 1.5 meters, taking into consideration the rules published by administrative bodies (current restrictions are published at https://www.gov.pl/web/koronawirus/aktualne-zasady-i-ograniczenia). If a queue is formed, the distance should be increased to 2 meters.
    5. The Participant is obliged to equip themselves with personal protective materials (mask, visor or other means of mouth and nose protection) and use them at all times while on the Event site by covering their mouth and nose. Failure to comply with these regimes will result in the Participant being asked to comply with the above obligations and, in the event of further evasion, will be asked to leave the Event premises.
    6. Hand disinfection is required before entering the Event area, disinfectant is available at the Event area.
    7. Event staff are equipped with personal protective equipment.
    8. Participants are obliged to comply with the requirements and rules applicable at the Event Venue, including compliance with posted signs and information boards, as well as to follow the instructions of Event staff.
    9. The spectators are obliged to take the seats indicated by persons operating the Event.
    10. It is recommended that appropriate social distance be kept when using the toilets, both in terms of using the rooms themselves and waiting for access to the rooms (maintaining a 2 meter distance).
  5. LIABILITY

    The Event Organizer is not liable for any property damage or non-property damage incurred by the Participant as a result of taking part in the Event.

  6. PERSONAL DATA PROCESSING AND IMAGE
    1. The Organizer is the administrator of personal data obtained from the Participants.
    2. In the matter of your personal data, you can contact the Organiser via the following e-mail address: kontakt@tedxwarsaw.org.
    3. The following personal data will be processed for the purposes of registration for the Event: first and last name, e-mail address, telephone number. Depending on the answers that the Participant provides in the open questions during the Event registration process, the Organiser may also process other categories of personal data than those indicated in the previous sentence.
    4. The Organiser shall process Participants' personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation; GDPR).
    5. At the same time, the Participants' personal data will possibly be processed by the Organizer in order to possibly inform the sanitary services about the possibility of contact with a person infected with SARSCoV-2, in particular on the basis of the following legal provisions:
      1. Article 6(1)(c) of the RODO, i.e. the processing is necessary to fulfil a legal obligation incumbent on the controller;
      2. b. the Act of March 2, 2020 on specific solutions related to preventing, counteracting and combating COVID-19, other infectious diseases and crisis situations caused by them (Journal of Laws of 2020, item 1842, as amended),
      3. c. guidelines for organizers of cultural and entertainment events during the SARS-CoV-2 virus epidemic in Poland published by the Ministry of Culture and National Heritage, Ministry of Development and Chief Sanitary Inspector.
    6. In connection with the processing of personal data by the Organiser, each person has the following rights:
      1. access to his or her data and to receive a copy thereof,
      2. to rectify (amend) his or her data if it is incorrect or out of date, as well as the right to have it erased if the processing of the data is not carried out in order to fulfil an obligation arising from a provision of law or in the exercise of public authority,
      3. to restrict or object to the processing of data,
      4. file a complaint to the President of the Office for Personal Data Protection (to the address of the Office for Personal Data Protection, 2 Stawki Street, 00-193 Warsaw).
    7. In order to exercise the rights referred to in Clause 6 above, please contact the Organiser using the e-mail address indicated in Clause 2 above.
    8. Providing personal data is voluntary, but lack of consent to provide such data will preclude participation in the Event.
    9. Personal data collected by the Organiser will not be subject to profiling.
    10. The Organiser may provide personal data of the Participants to entities cooperating with the Organiser in order to organise the Event.
    11. By taking part in the Event, the Participant agrees to have their image immortalized and used by taking photos or making video footage, which will be used for communication prepared and published by the Organiser after the Event. Consent for the use of their image may be revoked by sending an e-mail to: legal@tedxwarsaw.org.
  7. COMPLAINTS
    1. Participant has the right to file a complaint in the event of the course or quality of the Event.
    2. Complaints should be sent by e-mail to kontakt@tedxwarsaw.org within 7 days of the occurrence of the event forming the basis for lodging the complaint.
    3. The complaint should include at least: name, surname, e-mail address of the Participant submitting the complaint and a detailed description of the event forming the basis for the complaint.
    4. The Organiser will consider the complaint within 7 days of its receipt and will respond to the Participant at the address from which it was submitted.
  8. RESIGNATION FROM PARTICIPATION IN THE EVENT
    1. A Participant may resign from the participation in the Event no later than 7 days before the date of the Event.
    2. In order to resign from the participation in the Event, a Participant should contact the Organiser via kontakt@tedxwarsaw.org, providing:
      1. their name and surname,
      2. the bank account number to which the refund of the fee for participation in the Event will be transferred,
      3. a statement of withdrawal from the participation in the Event.
    3. The Organiser will accept only those cancellations that are in accordance with sec. 1 above and are submitted in the manner specified in sec. 2 above.
    4. In the case of a correctly submitted resignation, the Organiser will refund the Participant the fee less the 1.9% commission of the Przelewy24 platform. The refund for participation in the Event will be made to the bank account referred to in 2.b above.
    5. The right to participate in the Event cannot be transferred – for a fee or free of charge - to another natural or legal person.
  9. CANCELLATION OF AN EVENT

    Should it be necessary to cancel the Event due to force majeure (in particular, in the case of changes in restrictions related to the Coronavirus pandemic), the Organiser will refund the fees paid. The fee will be reduced by the commission of the Przelewy24 platform (1.9%).

  10. CLOSING REGULATIONS
    1. By participating in the Event, the Participant confirms that he or she has read and fully accepts the provisions of this Policy.
